Terms of Service

Overview

This website is operated by POGPACKS (“POGPACKS,” “we,” “us,” or “our”). We provide the website, store, and related services (collectively, the “Service”) subject to these Terms of Service (“Terms”). By accessing or using any part of the Service, or by purchasing from us, you agree to be bound by these Terms and by any policies referenced here or linked by hyperlink (collectively, the “Agreement”). If you disagree, do not use the Service.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services.

1. Eligibility & Store Terms

By using the Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents to use the site. You may not use the Service for any illegal or unauthorized purpose or violate any applicable laws (including intellectual property laws). Any breach may result in immediate termination of the Service.

2. General Conditions

We reserve the right to refuse service to anyone, for any reason, at any time. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks and adapted to technical requirements. Payment card data is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

3. Information Accuracy

We strive for accuracy but do not guarantee that information on the site is complete, current, or error-free. Historical or illustrative information may not reflect current stock or conditions. Use of information is at your own risk.

4. Modifications to Service & Prices

Prices and availability are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part thereof) at any time without liability.

5. Products & Collectibles

  • Limited Quantities. Some items are available in limited quantities only.

  • Condition & Authenticity. We only sell 100% authentic products. Sealed products are sold “as sealed” unless otherwise noted.

  • Stock Images. Some listings use stock photos; contact us for actual item images.

  • No Pull/Grade Guarantees. We do not guarantee card pulls, PSA/BGS/CGC grades, or centering.

  • Preorders. Release dates and allocations may change. We may cancel and refund preorders we cannot fulfill.

6. Billing & Account Information

We reserve the right to refuse or cancel any order at our discretion. Restrictions may apply per customer, household, or account. You agree to provide accurate, current billing and shipping information.

7. Third-Party Tools & Links

We may provide access to third-party tools or links we do not control. Access is provided “as is” without warranties. We are not responsible for the content, products, or services of third-party websites.

8. User Content; Feedback

If you submit ideas, suggestions, or content, you grant us a non-exclusive right to use it without obligation to compensate you. You must not infringe third-party rights or submit harmful content.

9. Cancellations, Returns & Refunds

  • Cancellations. Orders may be canceled before they have shipped. Once shipped, cancellations are no longer possible.

  • Refunds. Refund requests after shipping are considered on a case-by-case basis. To qualify, items must be returned in their original condition. A 5%-10% restocking fee will be deducted from all refunds on shipped orders.

  • Returns. Returned items must be in their original condition, including packaging, tags, and any accessories. Customers cover return shipping costs unless the return is due to our error.

9A. Heavy Packs – Guaranteed Holo Insurance Requirement

For heavy booster packs (packs identified as likely containing a holographic card), our Guaranteed Holo Insurance applies only if:

  • The tamper seal is visible on video before the pack is opened.

  • The opening and contents are presented uninterrupted on video.

  • The full recording is time-stamped and retained.

  • We reserve the right to decide if a refund or replacement is warranted.

  • Refunds will be refunded the amount at the time of purchase.

Openings without video, missing tamper seals, or incomplete footage are not eligible for insurance.

10. Shipping, Risk of Loss & Insurance

  • Processing. In-stock paid orders are normally dispatched the same day or the next business day. Rare delays can occur during major releases, high-volume periods, severe weather, carrier disruption or payment verification, and we will contact you if one affects your order.

  • Guaranteed dispatch. Every successfully paid order is guaranteed to be dispatched, subject only to fraud or payment verification and events that make fulfilment legally or physically impossible. Where we cannot fulfil an item, we contact you and provide an appropriate remedy, including a full refund for that item.

  • Tracking & insurance. Tracking is provided after dispatch where the selected service includes it, and shipping insurance is applied automatically to every order at no extra cost. We remain responsible for the shipment until the carrier records it as delivered. Carrier transit times and exact arrival dates are set by the carrier and are not guaranteed.

  • Delays, loss or damage. Contact us with your order number, and photos where an item arrives damaged. We investigate with the carrier and work toward an appropriate resolution under the included insurance coverage and applicable law.

  • International orders. Unless checkout states otherwise, duties, import taxes, customs fees and compliance with destination import laws are the buyer's responsibility. Customs authorities may inspect, open, repackage, delay, refuse or confiscate shipments and assess charges; those decisions are outside our control and we cannot cover charges, delays, confiscation or damage caused directly by customs handling where the carrier or insurance provides no coverage. We will supply documentation and reasonable assistance with a claim. Refused or unclaimed international shipments may be refunded after return and inspection, less unrecoverable outbound and return shipping, customs charges and fees, except where applicable law requires otherwise.

11. Errors & Inaccuracies

We reserve the right to correct pricing or listing errors at any time and to cancel or update orders as necessary.

12. Prohibited Uses

You may not use the Service for unlawful purposes, to infringe intellectual property rights, to harass or defame others, to upload malicious code, to mislead, or to interfere with site security.

13. Disclaimer of Warranties

The Service and all products are provided “as is” and “as available” without warranties, express or implied, including merchantability or fitness for a particular purpose.

14. Limitation of Liability

To the maximum extent allowed by Law, POGPACKS is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability shall not exceed the amount paid for the product/service giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless POGPACKS from any claims arising from your breach of these Terms or violation of Law or third-party rights.

16. Severability

If any provision is found to be unenforceable, the remainder of the Terms shall remain in effect.

17. Termination

We may terminate or suspend Service access if you breach these Terms. Your obligations for amounts due survive termination. 

18. Entire Agreement

These Terms, together with any policies posted on our site, constitute the entire Agreement between you and us and supersede prior agreements.

19. Governing Law

This Agreement is governed by the laws of the Commonwealth of Virginia, without regard to the conflict of law principles.

20. Changes to Terms

We reserve the right to update these Terms at any time by posting changes on our website. Continued use of the Service constitutes acceptance of any changes made to it.
